Terms of Service

1. Provider and agreement

SocialMint is operated by productivity-boost.com Betriebs UG (haftungsbeschränkt) & Co. KG, Reichenbergerstr. 2, 94036 Passau, Germany ("we" or "us"). Contact: info@productivity-boost.com. Company representation and registration details appear in our Impressum.

These terms govern your SocialMint account and subscription. You must have authority to act for any organization you register. Keep account details accurate and credentials private. SocialMint is intended for agencies and freelancers using it professionally.

2. Service and plans

The scope of service is as described on the pricing page at the time of subscription; early-access features may be rolled out gradually.

SocialMint is a hosted subscription service for preparing and scheduling social posts across brands and following publishing results. Agency also provides client approval links, API access, and an n8n node.

  • Starter: €19 per month, up to 3 brands and 1 user.
  • Agency: €49 per month, up to 15 brands and 5 users. Client reviewers using approval links do not consume team seats.

Prices include applicable VAT. Checkout shows the total recurring amount before an order is placed.

Supported launch networks are X, Bluesky, Mastodon, Telegram, and Threads. LinkedIn, Instagram, and Facebook are planned but unavailable pending platform approvals. No release dates are promised. Networks control their own permissions, limits, and availability; their rules also apply to your use.

3. Free trial and paid subscriptions

The 14-day trial starts in Checkout without a card. Without a payment method, your subscription ends automatically at trial end and you are not charged. If you add a payment method in the customer portal during the trial, billing starts at the displayed price when the trial ends. You can cancel anytime. The trial is available once per workspace. Restarting after a used trial requires a payment method and starts paid billing without another trial.

Paid subscriptions are billed monthly in advance through Stripe and renew for successive monthly billing periods until canceled. The checkout displays your plan, recurring price, and billing terms before payment. Your customer portal shows the next renewal date.

4. Cancellation, failed payments, and refunds

You may cancel anytime in the customer portal. Cancellation stops the next renewal; access continues until the end of the current paid billing period. There is no additional cancellation fee. If you cannot access the portal, contact us for help with cancellation.

We do not provide prorated refunds for unused portions of a billing period, except where required by law. Statutory refund, withdrawal, defect, and extraordinary termination rights remain unaffected. Where a refund is due, we return it through the original payment method where possible.

If payment fails, we notify you and give a reasonable opportunity to resolve it before suspending paid access, unless immediate action is legally necessary. Posts cannot be published through a suspended or expired subscription. Cancellation is separate from account deletion; retention is explained in our Privacy Policy.

Consumer right of withdrawal

Our offer is primarily intended for businesses. If you subscribe as a consumer, you have the right to withdraw from the contract within 14 days of its conclusion without giving a reason. The free trial does not replace this statutory right.

You may use the model form below, but it is not mandatory.

If you withdraw, we reimburse payments received without undue delay and no later than 14 days after receiving your notice, using the original payment method unless expressly agreed otherwise, without reimbursement fees. If you expressly requested the service to begin during the withdrawal period, you must pay a proportionate amount for the service provided up to your withdrawal. The right expires upon full performance only if the legal requirements, including your prior express consent and acknowledgment, are met.

5. Your content and acceptable use

You retain ownership of your content. You grant us the limited permission needed to store, process, display to your authorized reviewers, and transmit it to the networks you select, solely to provide the service. This includes using our service providers for those purposes.

You are responsible for your content, required permissions, account connections, publishing instructions, and compliance with applicable law and network rules. Client approval does not establish copyright ownership or legal compliance. Protect approval links and API credentials and notify us if access is compromised.

Do not use SocialMint for spam, unlawful content, impersonation, infringement, harassment, platform-rule violations, or attempts to bypass access controls or rate limits. Do not disrupt our service or other users. We may restrict access proportionately to address a breach, security threat, or legal requirement. Where feasible, we explain the reason and allow you to remedy the issue; urgent threats may require immediate suspension. Either party retains statutory rights to terminate for serious cause.

6. Publishing and availability

We operate the service with reasonable care on a best-effort basis. No specific uptime percentage or service-level agreement is included. Maintenance, faults, network outages, revoked permissions, and third-party restrictions may delay or prevent publication.

We show publishing status, errors, and retry activity. Some failures can be retried; others require your action. Scheduling or approving a post is not a guarantee that a network will publish it at an exact time. Monitor posts that are time-sensitive. This section does not remove our contractual duties or statutory remedies.

7. Liability

We are liable without limitation for intent, gross negligence, injury to life, body, or health, and liability that cannot lawfully be limited, including under the German Product Liability Act and for guarantees expressly assumed.

For ordinary negligence, we are liable for breach of an essential contractual obligation on which you may normally rely to receive the service. That liability is limited to foreseeable damage typical of this type of contract. Otherwise, liability for ordinary negligence is excluded to the extent permitted by law. These limits also apply to our representatives and persons performing our obligations. They do not restrict mandatory rights under data protection law.

8. Privacy and customer data

Our Privacy Policy explains personal-data processing, recipients, retention, and your rights. Where we process personal data on your instructions, a separate data processing agreement applies. A data processing agreement (DPA/AVV) is available on request via the contact address; a self-service version follows. You are responsible for a lawful basis and required notices for client content and reviewer data you provide.

9. Changes

We may improve the service without materially reducing the agreed subscription. Material changes to prices, core features, or these terms require a lawful basis and any consent required by law. We will explain proposed material changes and their effective date by email at least 30 days in advance. We do not treat silence alone as acceptance of a contractual amendment. If we cannot continue the existing contract without an agreed change, we may end it through lawful ordinary termination, with notice and any required refund for unused prepaid service. Urgent legal or security measures may take effect sooner where necessary.

10. Governing law and courts

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, this does not deprive you of mandatory protection under the law of your habitual residence.

If you are a merchant within the meaning of German commercial law, a legal entity under public law, or a special fund under public law, the courts in Passau have exclusive jurisdiction to the extent legally permitted. Otherwise, statutory jurisdiction rules apply. A freelancer is not automatically a merchant for this purpose.

If a provision is ineffective, statutory law replaces it and the remaining terms continue to apply.
